Thailand is changing its surrogacy laws to allow foreigners to hire Thai surrogate mothers.
Asia Egg Donors has learned that the Kingdom will be revising its surrogacy laws. This new law, if passed, will allow foreigners to legally hire Thai surrogate mothers to carry their babies. Right now under the 2015 surrogacy ban only married couples were allowed to hire a surrogate mother to carry their baby and one of the couples had to be a Thai national. The new law will also permit foreigners to do IVF in Thailand, make embryos, freeze them, and carry outside of Thailand to do surrogacy in another country if they wish to do so.
After being devastated by Covid for over 2 ½ years, Thailand realized it had to do something to revitalize its broken economy. The government also wants to promote Medical Tourism in the kingdom and catapult Thailand as a go to center for quality healthcare. Bangkok is the center of this medical hub and more people travel to Thailand than in any country in all of Asia. Realizing the surrogacy industry never dies even after the ban, if the Health Ministry can regulate surrogacy, it can be a huge part in helping the economy to get back on its feet again.
When the new revised surrogacy law takes effect, the Health Ministry will build a system so that Thai women who are interested in being surrogate mothers would be required to register with the health department. This will ensure children she carried will not be trafficked. Throughout the nine months of gestation and after she delivers the baby, hospitals in Thailand will have a tracking system which will enable them to check on the mother and the baby.
